關于國務院機構改革方案的說明

  各位代表:


  我受國(guo)務院委托,根據(ju)黨的二十屆二中全(quan)會通(tong)過的《黨和國(guo)家機構(gou)改(gai)(gai)革方案(an)》,就(jiu)國(guo)務院機構(gou)改(gai)(gai)革方案(an)向大會作說明,請予審議。


  黨(dang)的(de)(de)二十(shi)大對(dui)深化黨(dang)和(he)國(guo)(guo)家(jia)(jia)機(ji)(ji)構(gou)(gou)(gou)(gou)改(gai)革(ge)作出重要部署,黨(dang)的(de)(de)二十(shi)屆二中(zhong)(zhong)(zhong)全會審議通過(guo)《黨(dang)和(he)國(guo)(guo)家(jia)(jia)機(ji)(ji)構(gou)(gou)(gou)(gou)改(gai)革(ge)方案》。這次(ci)黨(dang)和(he)國(guo)(guo)家(jia)(jia)機(ji)(ji)構(gou)(gou)(gou)(gou)改(gai)革(ge)的(de)(de)總體(ti)要求是,貫徹落實黨(dang)的(de)(de)二十(shi)大精神,以習(xi)近平新時代(dai)中(zhong)(zhong)(zhong)國(guo)(guo)特色社會主(zhu)義(yi)思想為指(zhi)導(dao)(dao),以加(jia)強(qiang)黨(dang)中(zhong)(zhong)(zhong)央集中(zhong)(zhong)(zhong)統(tong)(tong)一領(ling)導(dao)(dao)為統(tong)(tong)領(ling),以推(tui)進(jin)國(guo)(guo)家(jia)(jia)治(zhi)理體(ti)系和(he)治(zhi)理能(neng)力現(xian)代(dai)化為導(dao)(dao)向,堅持穩中(zhong)(zhong)(zhong)求進(jin)工(gong)作總基調,適(shi)(shi)應統(tong)(tong)籌(chou)推(tui)進(jin)“五位一體(ti)”總體(ti)布(bu)局(ju)、協(xie)調推(tui)進(jin)“四個全面”戰略布(bu)局(ju)的(de)(de)要求,適(shi)(shi)應構(gou)(gou)(gou)(gou)建新發展格局(ju)、推(tui)動高質量發展的(de)(de)需要,堅持問題導(dao)(dao)向,統(tong)(tong)籌(chou)黨(dang)中(zhong)(zhong)(zhong)央機(ji)(ji)構(gou)(gou)(gou)(gou)、人大機(ji)(ji)構(gou)(gou)(gou)(gou)、國(guo)(guo)務院機(ji)(ji)構(gou)(gou)(gou)(gou)、政協(xie)機(ji)(ji)構(gou)(gou)(gou)(gou),統(tong)(tong)籌(chou)中(zhong)(zhong)(zhong)央和(he)地方,深化重點(dian)領(ling)域機(ji)(ji)構(gou)(gou)(gou)(gou)改(gai)革(ge),推(tui)動黨(dang)對(dui)社會主(zhu)義(yi)現(xian)代(dai)化建設的(de)(de)領(ling)導(dao)(dao)在機(ji)(ji)構(gou)(gou)(gou)(gou)設置上(shang)(shang)更加(jia)科(ke)學、在職能(neng)配置上(shang)(shang)更加(jia)優化、在體(ti)制機(ji)(ji)制上(shang)(shang)更加(jia)完善、在運行(xing)管理上(shang)(shang)更加(jia)。


  國務(wu)院機構改革(ge)作為(wei)黨和國家機構改革(ge)的(de)一(yi)項(xiang)重要任務(wu),重點(dian)是加強(qiang)科(ke)學技術、金(jin)融監(jian)管(guan)、數(shu)據管(guan)理、鄉(xiang)村振興、知(zhi)識產權、老齡工作等重點(dian)領域的(de)機構職責優(you)化和調(diao)整(zheng),轉變政府(fu)職能(neng),加快建設法治政府(fu)。


  這次國務院(yuan)機構改革(ge)的具體(ti)內容如下。


  一、重新組建科學技術部。科(ke)技(ji)(ji)(ji)(ji)創新在我國(guo)(guo)現代化(hua)建(jian)設全局中(zhong)(zhong)居于核心地(di)位。面對國(guo)(guo)際科(ke)技(ji)(ji)(ji)(ji)競爭和(he)(he)外部遏制打(da)壓(ya)的嚴峻(jun)形勢,必須進(jin)一步理順科(ke)技(ji)(ji)(ji)(ji)領導和(he)(he)管(guan)理體(ti)制,更好統籌科(ke)技(ji)(ji)(ji)(ji)力(li)量在關鍵核心技(ji)(ji)(ji)(ji)術(shu)上攻堅克難,加(jia)快實(shi)現高水平科(ke)技(ji)(ji)(ji)(ji)自立自強(qiang)(qiang)。這次(ci)黨(dang)和(he)(he)國(guo)(guo)家機構(gou)改革,加(jia)強(qiang)(qiang)黨(dang)中(zhong)(zhong)央對科(ke)技(ji)(ji)(ji)(ji)工作的集中(zhong)(zhong)統一領導,組建(jian)中(zhong)(zhong)央科(ke)技(ji)(ji)(ji)(ji)委員會,中(zhong)(zhong)央科(ke)技(ji)(ji)(ji)(ji)委員會辦事機構(gou)職責由重組后的科(ke)學(xue)技(ji)(ji)(ji)(ji)術(shu)部整體(ti)承擔。根據(ju)《黨(dang)和(he)(he)國(guo)(guo)家機構(gou)改革方(fang)案》精(jing)神(shen),強(qiang)(qiang)化(hua)科(ke)學(xue)技(ji)(ji)(ji)(ji)術(shu)部的戰略規劃、體(ti)制改革、資源(yuan)統籌、綜合協調(diao)、政策法規、督促(cu)檢查等宏(hong)觀管(guan)理職責,推動(dong)健(jian)全新型舉國(guo)(guo)體(ti)制、優(you)化(hua)科(ke)技(ji)(ji)(ji)(ji)創新全鏈條管(guan)理、促(cu)進(jin)科(ke)技(ji)(ji)(ji)(ji)成果轉化(hua)、促(cu)進(jin)科(ke)技(ji)(ji)(ji)(ji)和(he)(he)經濟社會發展相(xiang)結合。


  劃(hua)(hua)轉科(ke)(ke)學(xue)技(ji)(ji)(ji)術部(bu)具體管理職(zhi)(zhi)責(ze)(ze)。把(ba)(ba)組織擬(ni)訂科(ke)(ke)技(ji)(ji)(ji)促進農(nong)(nong)業(ye)(ye)農(nong)(nong)村(cun)發(fa)(fa)展(zhan)規(gui)劃(hua)(hua)和(he)政策、指(zhi)導農(nong)(nong)村(cun)科(ke)(ke)技(ji)(ji)(ji)進步職(zhi)(zhi)責(ze)(ze)劃(hua)(hua)入(ru)農(nong)(nong)業(ye)(ye)農(nong)(nong)村(cun)部(bu)。把(ba)(ba)組織擬(ni)訂科(ke)(ke)技(ji)(ji)(ji)促進社(she)會(hui)發(fa)(fa)展(zhan)規(gui)劃(hua)(hua)和(he)政策職(zhi)(zhi)責(ze)(ze)分別劃(hua)(hua)入(ru)國(guo)(guo)家(jia)發(fa)(fa)展(zhan)和(he)改革委員會(hui)、生(sheng)態環境(jing)部(bu)、國(guo)(guo)家(jia)衛生(sheng)健康委員會(hui)等部(bu)門。把(ba)(ba)組織擬(ni)訂高(gao)新(xin)(xin)技(ji)(ji)(ji)術發(fa)(fa)展(zhan)及產(chan)業(ye)(ye)化(hua)規(gui)劃(hua)(hua)和(he)政策,指(zhi)導國(guo)(guo)家(jia)自主(zhu)創新(xin)(xin)示范區、國(guo)(guo)家(jia)高(gao)新(xin)(xin)技(ji)(ji)(ji)術產(chan)業(ye)(ye)開(kai)發(fa)(fa)區等科(ke)(ke)技(ji)(ji)(ji)園(yuan)區建設,指(zhi)導科(ke)(ke)技(ji)(ji)(ji)服務(wu)業(ye)(ye)、技(ji)(ji)(ji)術市(shi)場、科(ke)(ke)技(ji)(ji)(ji)中介組織發(fa)(fa)展(zhan)等職(zhi)(zhi)責(ze)(ze)劃(hua)(hua)入(ru)工(gong)業(ye)(ye)和(he)信息化(hua)部(bu)。把(ba)(ba)負責(ze)(ze)引進國(guo)(guo)外(wai)智力(li)工(gong)作(zuo)職(zhi)(zhi)責(ze)(ze)劃(hua)(hua)入(ru)人(ren)力(li)資(zi)源(yuan)和(he)社(she)會(hui)保(bao)障(zhang)部(bu),在人(ren)力(li)資(zi)源(yuan)和(he)社(she)會(hui)保(bao)障(zhang)部(bu)加掛(gua)國(guo)(guo)家(jia)外(wai)國(guo)(guo)專家(jia)局牌子。科(ke)(ke)學(xue)技(ji)(ji)(ji)術部(bu)不再保(bao)留國(guo)(guo)家(jia)外(wai)國(guo)(guo)專家(jia)局牌子。


  深化財(cai)(cai)政科(ke)(ke)(ke)技(ji)(ji)(ji)(ji)(ji)(ji)經費分配使用機(ji)制改革,完(wan)善中(zhong)(zhong)央(yang)財(cai)(cai)政科(ke)(ke)(ke)技(ji)(ji)(ji)(ji)(ji)(ji)計劃(hua)(hua)執行和(he)專(zhuan)業機(ji)構管(guan)(guan)理(li)(li)體制,調(diao)整科(ke)(ke)(ke)學(xue)(xue)(xue)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)部的中(zhong)(zhong)央(yang)財(cai)(cai)政科(ke)(ke)(ke)技(ji)(ji)(ji)(ji)(ji)(ji)計劃(hua)(hua)(專(zhuan)項、基(ji)(ji)金等)協(xie)調(diao)管(guan)(guan)理(li)(li)、科(ke)(ke)(ke)研項目資金協(xie)調(diao)評(ping)估等職(zhi)責(ze)。重(zhong)組后的科(ke)(ke)(ke)學(xue)(xue)(xue)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)部不再參與(yu)具(ju)體科(ke)(ke)(ke)研項目評(ping)審和(he)管(guan)(guan)理(li)(li),主(zhu)要(yao)負(fu)責(ze)指導監督科(ke)(ke)(ke)研管(guan)(guan)理(li)(li)專(zhuan)業機(ji)構的運行管(guan)(guan)理(li)(li),加強對科(ke)(ke)(ke)研項目實施情況的督促檢查(cha)和(he)科(ke)(ke)(ke)研成果的評(ping)估問(wen)效。相應把科(ke)(ke)(ke)學(xue)(xue)(xue)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)部所屬中(zhong)(zhong)國農(nong)村(cun)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)開(kai)發(fa)中(zhong)(zhong)心(xin)劃(hua)(hua)入(ru)農(nong)業農(nong)村(cun)部,中(zhong)(zhong)國生(sheng)物技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)發(fa)展中(zhong)(zhong)心(xin)劃(hua)(hua)入(ru)國家(jia)衛(wei)生(sheng)健(jian)康委員(yuan)會,中(zhong)(zhong)國21世紀議程(cheng)管(guan)(guan)理(li)(li)中(zhong)(zhong)心(xin)、科(ke)(ke)(ke)學(xue)(xue)(xue)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)部高技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)研究發(fa)展中(zhong)(zhong)心(xin)劃(hua)(hua)入(ru)國家(jia)自然科(ke)(ke)(ke)學(xue)(xue)(xue)基(ji)(ji)金委員(yuan)會。國家(jia)自然科(ke)(ke)(ke)學(xue)(xue)(xue)基(ji)(ji)金委員(yuan)會仍由科(ke)(ke)(ke)學(xue)(xue)(xue)技(ji)(ji)(ji)(ji)(ji)(ji)術(shu)(shu)部管(guan)(guan)理(li)(li)。


  二、組建國家金融監督管理總局。黨的二十大作出明確部署,要依(yi)法(fa)將各類金(jin)(jin)融(rong)(rong)(rong)(rong)活動全部納入監(jian)(jian)(jian)(jian)管(guan)(guan)。為(wei)解決金(jin)(jin)融(rong)(rong)(rong)(rong)領域長期存在的突出矛盾和(he)問題,在中(zhong)國(guo)銀(yin)行(xing)保(bao)(bao)險(xian)監(jian)(jian)(jian)(jian)督(du)(du)管(guan)(guan)理(li)委員會基(ji)礎上(shang)組建國(guo)家金(jin)(jin)融(rong)(rong)(rong)(rong)監(jian)(jian)(jian)(jian)督(du)(du)管(guan)(guan)理(li)總(zong)局,統(tong)(tong)一負責(ze)除證券業之外的金(jin)(jin)融(rong)(rong)(rong)(rong)業監(jian)(jian)(jian)(jian)管(guan)(guan),強(qiang)(qiang)化機構(gou)監(jian)(jian)(jian)(jian)管(guan)(guan)、行(xing)為(wei)監(jian)(jian)(jian)(jian)管(guan)(guan)、功能監(jian)(jian)(jian)(jian)管(guan)(guan)、穿透式(shi)監(jian)(jian)(jian)(jian)管(guan)(guan)、持續監(jian)(jian)(jian)(jian)管(guan)(guan),統(tong)(tong)籌負責(ze)金(jin)(jin)融(rong)(rong)(rong)(rong)消(xiao)(xiao)費(fei)者(zhe)權(quan)益保(bao)(bao)護(hu),加強(qiang)(qiang)風險(xian)管(guan)(guan)理(li)和(he)防范處置,依(yi)法(fa)查處違法(fa)違規行(xing)為(wei),作為(wei)國(guo)務(wu)(wu)院(yuan)直屬機構(gou)。為(wei)加強(qiang)(qiang)金(jin)(jin)融(rong)(rong)(rong)(rong)消(xiao)(xiao)費(fei)者(zhe)合法(fa)權(quan)益保(bao)(bao)護(hu),統(tong)(tong)一規范金(jin)(jin)融(rong)(rong)(rong)(rong)產品和(he)服務(wu)(wu)行(xing)為(wei),把中(zhong)國(guo)人(ren)民銀(yin)行(xing)對金(jin)(jin)融(rong)(rong)(rong)(rong)控股公司等金(jin)(jin)融(rong)(rong)(rong)(rong)集團的日常監(jian)(jian)(jian)(jian)管(guan)(guan)職(zhi)責(ze)、有關(guan)金(jin)(jin)融(rong)(rong)(rong)(rong)消(xiao)(xiao)費(fei)者(zhe)保(bao)(bao)護(hu)職(zhi)責(ze),中(zhong)國(guo)證券監(jian)(jian)(jian)(jian)督(du)(du)管(guan)(guan)理(li)委員會的投資(zi)者(zhe)保(bao)(bao)護(hu)職(zhi)責(ze)劃(hua)入國(guo)家金(jin)(jin)融(rong)(rong)(rong)(rong)監(jian)(jian)(jian)(jian)督(du)(du)管(guan)(guan)理(li)總(zong)局。不再保(bao)(bao)留中(zhong)國(guo)銀(yin)行(xing)保(bao)(bao)險(xian)監(jian)(jian)(jian)(jian)督(du)(du)管(guan)(guan)理(li)委員會。


  三、深化地方金融監管體制改革。針對地(di)(di)(di)方(fang)金(jin)融(rong)(rong)(rong)(rong)監(jian)管(guan)(guan)(guan)部(bu)門存在的(de)監(jian)管(guan)(guan)(guan)手段缺(que)乏(fa)、專(zhuan)(zhuan)業人才(cai)不(bu)(bu)足等(deng)問題(ti),強化金(jin)融(rong)(rong)(rong)(rong)管(guan)(guan)(guan)理(li)中央(yang)事權,建立(li)以(yi)中央(yang)金(jin)融(rong)(rong)(rong)(rong)管(guan)(guan)(guan)理(li)部(bu)門地(di)(di)(di)方(fang)派(pai)出機(ji)構(gou)(gou)為(wei)主的(de)地(di)(di)(di)方(fang)金(jin)融(rong)(rong)(rong)(rong)監(jian)管(guan)(guan)(guan)體(ti)制,統(tong)籌優化中央(yang)金(jin)融(rong)(rong)(rong)(rong)管(guan)(guan)(guan)理(li)部(bu)門地(di)(di)(di)方(fang)派(pai)出機(ji)構(gou)(gou)設(she)置和力量配備(bei)。同(tong)時,壓實地(di)(di)(di)方(fang)金(jin)融(rong)(rong)(rong)(rong)監(jian)管(guan)(guan)(guan)主體(ti)責(ze)任,地(di)(di)(di)方(fang)政府設(she)立(li)的(de)金(jin)融(rong)(rong)(rong)(rong)監(jian)管(guan)(guan)(guan)機(ji)構(gou)(gou)專(zhuan)(zhuan)司監(jian)管(guan)(guan)(guan)職責(ze),不(bu)(bu)再加掛金(jin)融(rong)(rong)(rong)(rong)工(gong)作局(ju)、金(jin)融(rong)(rong)(rong)(rong)辦公室等(deng)牌(pai)子。


  四、中國證券監督管理委員會調整為國務院直屬機構。為(wei)強化資本市場監(jian)(jian)管職責,中國(guo)證券(quan)監(jian)(jian)督(du)(du)管理委員(yuan)會由(you)國(guo)務院(yuan)直屬(shu)事業單(dan)位調(diao)整為(wei)國(guo)務院(yuan)直屬(shu)機構。理順(shun)債(zhai)券(quan)管理體制(zhi),將國(guo)家發展和改革(ge)委員(yuan)會的企(qi)業債(zhai)券(quan)發行審(shen)核職責劃入中國(guo)證券(quan)監(jian)(jian)督(du)(du)管理委員(yuan)會,由(you)中國(guo)證券(quan)監(jian)(jian)督(du)(du)管理委員(yuan)會統一負(fu)責公司(企(qi)業)債(zhai)券(quan)發行審(shen)核工作。


  五、統籌推進中國人民銀行分支機構改革。調整中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)大(da)區(qu)分(fen)(fen)行(xing)(xing)(xing)(xing)體制,按(an)照行(xing)(xing)(xing)(xing)政(zheng)區(qu)設(she)立(li)分(fen)(fen)支機構。撤(che)銷中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)大(da)區(qu)分(fen)(fen)行(xing)(xing)(xing)(xing)及分(fen)(fen)行(xing)(xing)(xing)(xing)營業管(guan)(guan)(guan)(guan)理(li)(li)部(bu)、總行(xing)(xing)(xing)(xing)直屬(shu)營業管(guan)(guan)(guan)(guan)理(li)(li)部(bu)和省會城市中(zhong)(zhong)(zhong)心(xin)(xin)支行(xing)(xing)(xing)(xing),在(zai)31個(ge)省(自(zi)治(zhi)區(qu)、直轄市)設(she)立(li)省級分(fen)(fen)行(xing)(xing)(xing)(xing),在(zai)深圳、大(da)連、寧波、青島、廈門設(she)立(li)計劃(hua)單列市分(fen)(fen)行(xing)(xing)(xing)(xing)。中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)北(bei)京(jing)分(fen)(fen)行(xing)(xing)(xing)(xing)保留中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)營業管(guan)(guan)(guan)(guan)理(li)(li)部(bu)牌子,中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)上(shang)海(hai)分(fen)(fen)行(xing)(xing)(xing)(xing)與(yu)中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)上(shang)海(hai)總部(bu)合署(shu)辦公。不再保留中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)縣(市)支行(xing)(xing)(xing)(xing),相關(guan)職能(neng)上(shang)收(shou)至中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)地(市)中(zhong)(zhong)(zhong)心(xin)(xin)支行(xing)(xing)(xing)(xing)。對(dui)邊境或(huo)外貿結售匯業務(wu)量大(da)的地區(qu),可根據工作需要,采取中(zhong)(zhong)(zhong)國(guo)(guo)(guo)人(ren)(ren)民銀(yin)行(xing)(xing)(xing)(xing)地(市)中(zhong)(zhong)(zhong)心(xin)(xin)支行(xing)(xing)(xing)(xing)派出機構方式履(lv)行(xing)(xing)(xing)(xing)相關(guan)管(guan)(guan)(guan)(guan)理(li)(li)服(fu)務(wu)職能(neng)。


  六、完善國有金融資本管理體制。國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)資本是推進(jin)國(guo)(guo)家(jia)(jia)(jia)現(xian)代化(hua)、維(wei)護國(guo)(guo)家(jia)(jia)(jia)金(jin)(jin)(jin)融(rong)(rong)安全的(de)(de)(de)(de)重要保障,是我們黨和國(guo)(guo)家(jia)(jia)(jia)事(shi)業發(fa)展的(de)(de)(de)(de)重要物質基礎和政治基礎。為厘清金(jin)(jin)(jin)融(rong)(rong)監管部(bu)門(men)、履行國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)資本出(chu)資人職責(ze)(ze)的(de)(de)(de)(de)機構(gou)和國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)機構(gou)之(zhi)間的(de)(de)(de)(de)權責(ze)(ze)關系,推進(jin)管辦分(fen)離、政企分(fen)開,把(ba)中央金(jin)(jin)(jin)融(rong)(rong)管理部(bu)門(men)管理的(de)(de)(de)(de)市場經營類機構(gou)剝離,相關國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)資產劃入國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)資本受托(tuo)管理機構(gou),由其根(gen)據國(guo)(guo)務院授(shou)權統一履行出(chu)資人職責(ze)(ze),促進(jin)國(guo)(guo)有(you)金(jin)(jin)(jin)融(rong)(rong)機構(gou)持(chi)續健康發(fa)展。


  七、加強金融管理部門工作人員統一規范管理。為促進(jin)金融管(guan)理(li)(li)(li)部(bu)門(men)依法合規履(lv)行(xing)金融管(guan)理(li)(li)(li)職責,解決金融系(xi)統隊(dui)伍管(guan)理(li)(li)(li)的(de)統一性(xing)、規范性(xing)問題,把中國(guo)(guo)(guo)(guo)(guo)(guo)人(ren)民銀(yin)行(xing)、國(guo)(guo)(guo)(guo)(guo)(guo)家(jia)(jia)金融監督管(guan)理(li)(li)(li)總局(ju)、中國(guo)(guo)(guo)(guo)(guo)(guo)證券監督管(guan)理(li)(li)(li)委員(yuan)(yuan)會、國(guo)(guo)(guo)(guo)(guo)(guo)家(jia)(jia)外匯管(guan)理(li)(li)(li)局(ju)及其分(fen)支(zhi)機構、派(pai)出(chu)機構的(de)工(gong)作人(ren)員(yuan)(yuan)納入(ru)國(guo)(guo)(guo)(guo)(guo)(guo)家(jia)(jia)公務(wu)員(yuan)(yuan)統一規范管(guan)理(li)(li)(li),使用行(xing)政編制,執(zhi)行(xing)國(guo)(guo)(guo)(guo)(guo)(guo)家(jia)(jia)公務(wu)員(yuan)(yuan)工(gong)資待遇標準。


  八、組建國家數據局。當今社(she)會(hui)(hui),數(shu)(shu)字資(zi)源、數(shu)(shu)字經(jing)濟(ji)對經(jing)濟(ji)社(she)會(hui)(hui)發(fa)展(zhan)具有(you)基礎性作用,對于構建(jian)(jian)新發(fa)展(zhan)格(ge)局、建(jian)(jian)設(she)(she)現代(dai)化(hua)(hua)經(jing)濟(ji)體(ti)(ti)系、構筑(zhu)國(guo)(guo)(guo)(guo)(guo)家(jia)競爭新優勢(shi)意義重(zhong)大(da),必須加強(qiang)對數(shu)(shu)據的(de)(de)管(guan)(guan)理(li)、開(kai)發(fa)、利(li)用。在保持數(shu)(shu)據安全(quan)、行業數(shu)(shu)據監管(guan)(guan)、信息(xi)(xi)化(hua)(hua)發(fa)展(zhan)、數(shu)(shu)字政府建(jian)(jian)設(she)(she)等(deng)現行工(gong)作格(ge)局總體(ti)(ti)穩定前提下,把(ba)數(shu)(shu)據資(zi)源整合共(gong)享和開(kai)發(fa)利(li)用方(fang)面的(de)(de)有(you)關職(zhi)責(ze)(ze)相(xiang)對集(ji)中(zhong),組建(jian)(jian)國(guo)(guo)(guo)(guo)(guo)家(jia)數(shu)(shu)據局,作為國(guo)(guo)(guo)(guo)(guo)家(jia)發(fa)展(zhan)和改革委員(yuan)會(hui)(hui)管(guan)(guan)理(li)的(de)(de)國(guo)(guo)(guo)(guo)(guo)家(jia)局,負責(ze)(ze)協調(diao)推(tui)(tui)進數(shu)(shu)據基礎制度(du)建(jian)(jian)設(she)(she),統(tong)(tong)籌推(tui)(tui)進數(shu)(shu)字中(zhong)國(guo)(guo)(guo)(guo)(guo)、數(shu)(shu)字經(jing)濟(ji)、數(shu)(shu)字社(she)會(hui)(hui)規劃和建(jian)(jian)設(she)(she)等(deng)。把(ba)中(zhong)央網絡(luo)安全(quan)和信息(xi)(xi)化(hua)(hua)委員(yuan)會(hui)(hui)辦公(gong)(gong)室承擔的(de)(de)研究擬訂數(shu)(shu)字中(zhong)國(guo)(guo)(guo)(guo)(guo)建(jian)(jian)設(she)(she)方(fang)案、協調(diao)推(tui)(tui)動公(gong)(gong)共(gong)服務和社(she)會(hui)(hui)治理(li)信息(xi)(xi)化(hua)(hua)、協調(diao)促(cu)進智慧(hui)城市建(jian)(jian)設(she)(she)、協調(diao)國(guo)(guo)(guo)(guo)(guo)家(jia)重(zhong)要信息(xi)(xi)資(zi)源開(kai)發(fa)利(li)用與共(gong)享、推(tui)(tui)動信息(xi)(xi)資(zi)源跨(kua)(kua)行業跨(kua)(kua)部(bu)門互聯互通等(deng)職(zhi)責(ze)(ze),國(guo)(guo)(guo)(guo)(guo)家(jia)發(fa)展(zhan)和改革委員(yuan)會(hui)(hui)承擔的(de)(de)統(tong)(tong)籌推(tui)(tui)進數(shu)(shu)字經(jing)濟(ji)發(fa)展(zhan)、組織(zhi)實施國(guo)(guo)(guo)(guo)(guo)家(jia)大(da)數(shu)(shu)據戰略、推(tui)(tui)進數(shu)(shu)據要素基礎制度(du)建(jian)(jian)設(she)(she)、推(tui)(tui)進數(shu)(shu)字基礎設(she)(she)施布(bu)局建(jian)(jian)設(she)(she)等(deng)職(zhi)責(ze)(ze)劃入(ru)國(guo)(guo)(guo)(guo)(guo)家(jia)數(shu)(shu)據局。


  九、優化農業農村部職責。為(wei)統(tong)籌(chou)抓好以鄉村(cun)振(zhen)(zhen)興(xing)為(wei)重心(xin)的(de)“三農(nong)(nong)(nong)”各項工(gong)作(zuo),加快建(jian)設農(nong)(nong)(nong)業(ye)強國,整體推動農(nong)(nong)(nong)業(ye)全面(mian)升級、農(nong)(nong)(nong)村(cun)全面(mian)進步、農(nong)(nong)(nong)民(min)全面(mian)發(fa)展,把國家鄉村(cun)振(zhen)(zhen)興(xing)局(ju)的(de)牽頭開展防止返貧監測和(he)幫(bang)扶,組織(zhi)擬訂鄉村(cun)振(zhen)(zhen)興(xing)重點幫(bang)扶縣(xian)和(he)重點地區幫(bang)扶政策,組織(zhi)開展東(dong)西(xi)部協作(zuo)、對(dui)口支援(yuan)、社會幫(bang)扶,研究提出(chu)中央(yang)財政銜接推進鄉村(cun)振(zhen)(zhen)興(xing)相關資(zi)(zi)金(jin)分(fen)配(pei)建(jian)議方案(an)并指導、監督(du)資(zi)(zi)金(jin)使用,推動鄉村(cun)幫(bang)扶產業(ye)發(fa)展,推動農(nong)(nong)(nong)村(cun)社會事業(ye)和(he)公共服務發(fa)展等職責(ze)劃入農(nong)(nong)(nong)業(ye)農(nong)(nong)(nong)村(cun)部,在農(nong)(nong)(nong)業(ye)農(nong)(nong)(nong)村(cun)部加掛國家鄉村(cun)振(zhen)(zhen)興(xing)局(ju)牌子。不再保(bao)留單設的(de)國家鄉村(cun)振(zhen)(zhen)興(xing)局(ju)。


  國家鄉村振(zhen)興局職責劃入農業農村部,要繼續加(jia)大對脫貧地區和脫貧群眾的(de)幫扶(fu)力度(du),脫貧攻堅目(mu)標任(ren)務完成(cheng)后的(de)過渡期內,有關幫扶(fu)政策(ce)、財政支(zhi)持、項目(mu)安排保(bao)持總體穩定,資金項目(mu)相(xiang)對獨立運(yun)行管理(li)。


  十、完善老齡工作體制。為實(shi)(shi)施(shi)積極應對人(ren)口老(lao)(lao)(lao)齡(ling)(ling)(ling)化(hua)國家戰略,更(geng)好(hao)發(fa)(fa)展養(yang)老(lao)(lao)(lao)事業(ye)和養(yang)老(lao)(lao)(lao)產業(ye),推(tui)動(dong)實(shi)(shi)現(xian)全(quan)體老(lao)(lao)(lao)年人(ren)享(xiang)有基(ji)本(ben)養(yang)老(lao)(lao)(lao)服務,把國家衛生健(jian)康委(wei)(wei)員(yuan)會(hui)(hui)的組織擬訂(ding)并協(xie)調落實(shi)(shi)應對人(ren)口老(lao)(lao)(lao)齡(ling)(ling)(ling)化(hua)政(zheng)策措施(shi)、承擔(dan)老(lao)(lao)(lao)齡(ling)(ling)(ling)工(gong)作(zuo)委(wei)(wei)員(yuan)會(hui)(hui)的具體工(gong)作(zuo)等職責(ze)劃入(ru)民政(zheng)部(bu)(bu)(bu)。老(lao)(lao)(lao)齡(ling)(ling)(ling)工(gong)作(zuo)委(wei)(wei)員(yuan)會(hui)(hui)辦(ban)公(gong)室改設(she)在(zai)民政(zheng)部(bu)(bu)(bu),強化(hua)其綜合協(xie)調、督促指(zhi)導、組織推(tui)進老(lao)(lao)(lao)齡(ling)(ling)(ling)事業(ye)發(fa)(fa)展職責(ze)。中國老(lao)(lao)(lao)齡(ling)(ling)(ling)協(xie)會(hui)(hui)改由民政(zheng)部(bu)(bu)(bu)代管(guan)。


  十一、完善知識產權管理體制。為(wei)適應推(tui)進創新型(xing)國(guo)家建(jian)設、推(tui)動高(gao)(gao)質量發(fa)展、擴大(da)高(gao)(gao)水平(ping)對外開放的內在需要,加快推(tui)進知識產(chan)權強國(guo)建(jian)設,全面提升知識產(chan)權創造(zao)、運用、保護、管理(li)和服務水平(ping),將國(guo)家知識產(chan)權局(ju)由國(guo)家市(shi)場監督(du)管理(li)總局(ju)管理(li)的國(guo)家局(ju)調(diao)整為(wei)國(guo)務院直屬(shu)機構。商標、專(zhuan)利(li)等(deng)領域執法(fa)職責繼續由市(shi)場監管綜(zong)合執法(fa)隊伍承擔,相(xiang)關執法(fa)工作接受國(guo)家知識產(chan)權局(ju)專(zhuan)業指(zhi)導。


  十二、國家信訪局調整為國務院直屬機構。為貫(guan)徹落實新時代黨的群(qun)眾路線,加強和(he)改進人民(min)信訪工作,更好維護人民(min)根本利益(yi),將(jiang)國(guo)(guo)家(jia)信訪局由(you)國(guo)(guo)務(wu)院辦公(gong)廳管理的國(guo)(guo)家(jia)局調整為國(guo)(guo)務(wu)院直屬機構。


  十三、精減中央國家機關人員編制。中(zhong)央國家機關各部門(men)人(ren)員編(bian)制統一(yi)按照5%的(de)比例進行(xing)精(jing)減,收(shou)回(hui)的(de)編(bian)制主要用于加強重(zhong)點領(ling)域和重(zhong)要工作。對(dui)于精(jing)減后(hou)少數部門(men)超編(bian)問(wen)題,給予5年過渡期(qi)逐步消化。


  各位代表,按照上述方(fang)案調整后,除國務院(yuan)(yuan)辦公廳(ting)外,國務院(yuan)(yuan)設(she)置組(zu)成部門(men)仍為(wei)26個。根據國務院(yuan)(yuan)組(zu)織法規(gui)定,科學技術部、農業農村(cun)部等(deng)國務院(yuan)(yuan)組(zu)成部門(men)的(de)調整和設(she)置,請大會審議(yi)。


  國(guo)(guo)家(jia)(jia)市場監(jian)督(du)(du)管理(li)總(zong)局(ju)(ju)、國(guo)(guo)家(jia)(jia)金融監(jian)督(du)(du)管理(li)總(zong)局(ju)(ju)、中國(guo)(guo)證券監(jian)督(du)(du)管理(li)委員會(hui)、國(guo)(guo)家(jia)(jia)信訪局(ju)(ju)、國(guo)(guo)家(jia)(jia)知識產(chan)權局(ju)(ju)、國(guo)(guo)家(jia)(jia)數據局(ju)(ju)、國(guo)(guo)家(jia)(jia)鄉村振興局(ju)(ju)等國(guo)(guo)務(wu)院(yuan)組成部門以外(wai)的國(guo)(guo)務(wu)院(yuan)所(suo)屬機構的調整和設置(zhi),將由新組成的國(guo)(guo)務(wu)院(yuan)審(shen)查批準。


  下一(yi)(yi)步在機(ji)構(gou)(gou)改(gai)革(ge)實(shi)施(shi)工(gong)作(zuo)中(zhong)(zhong),我們(men)將深刻(ke)認識“兩個(ge)確立”的決定(ding)性意義(yi),增強“四(si)個(ge)意識”、堅定(ding)“四(si)個(ge)自信”、做到“兩個(ge)維護”,堅決維護黨(dang)中(zhong)(zhong)央(yang)權威和集(ji)中(zhong)(zhong)統一(yi)(yi)領導,認真貫徹落實(shi)黨(dang)中(zhong)(zhong)央(yang)關于(yu)黨(dang)和國家機(ji)構(gou)(gou)改(gai)革(ge)的決策部署(shu),抓好(hao)改(gai)革(ge)關鍵環(huan)節,做好(hao)思(si)想政治(zhi)工(gong)作(zuo),嚴(yan)肅改(gai)革(ge)紀律(lv),確保機(ji)構(gou)(gou)、職責、人員(yuan)等按要求及時調整到位(wei),做到思(si)想不(bu)亂、工(gong)作(zuo)不(bu)斷、隊伍不(bu)散、干勁不(bu)減。
